Abstract
Abstract This chapter examines the evolution, implementation, and transformative potential of Spain’s recent equal pay legislation, particularly Royal Decree-Law 6/2019 and its subsequent regulatory decrees (RD 901/2020 and RD 902/2020). The analysis shows, through documentary analysis and in-depth interviews with key stakeholders, the legislative shift from promotional to binding measures, including mandatory pay audits and equality plans, which reflects a state-driven and coercive approach to gender equality in the workplace. However, challenges in implementation persist due to political instability, employer resistance, and limited administrative resources, particularly in small enterprises. While the reforms mark a significant step toward gender transformation, the analysis underscores the incomplete nature of this journey, highlighting gaps in intersectional inclusion, uneven social dialogue, and the need for deeper cultural change. Spain’s case offers valuable insights into the complex relationship between institutional design, political opportunity structures, and gendered power dynamics in advancing equality in labor markets.
