Abstract
Abstract This chapter examines how AI reshapes the risk landscape for English insurance law. It argues that AI does not alter the core legal essence of risk as a fortuitous, adverse contingency capable of contractual transfer, but it changes the conditions under which risk is identified, priced, disclosed, proved, and pooled. After clarifying the meaning of risk in insurance law, the chapter maps AI-related risks through the distinctive features of AI systems: autonomy, opacity, adaptivity, scale, and systemic interconnection. These features complicate agency, causation, accountability, disclosure, underwriting, and aggregation, while exposing limits in traditional liability and insurance frameworks. Focusing on the UK context, with comparative reference to EU developments, the chapter concludes that the main challenge is not redefining risk, but recalibrating insurance law and insurance design to preserve compensation, accountability, and insurability in the AI age.
