Abstract
Abstract This chapter provides an analysis of the preamble and guiding principles of the Global Compact for Safe, Orderly and Regular Migration (GCM), framing it as an ambitious, albeit non-binding, project for multilateralism in a politically contested field. The chapter first traces the GCM’s normative origins and drafting process. It then explores its legal foundations, arguing that its power derives not from legal force but from its role as a soft law coordinating device that interacts with existing binding international norms. The chapter also provides a critical assessment of the alleged 360-degree vision of the Compact and analyses the guiding principles that inform the whole document. It concludes that the GCM represents a singular achievement in recognizing migration as a matter of international concern, yet it also epitomizes the inherent tensions and limitations of soft law, serving as an ongoing process rather than a final product.
