Abstract
Abstract This chapter concerns Objective 15 of the GCM, which deals with migrants’ access to basic services. The core question addressed is whether this Objective merely reaffirms pre-existing state obligations or meaningfully expands and concretizes them. The chapter first delineates the core human rights standards concerning access to essential services, such as healthcare, education, and justice. The chapter then scrutinizes the Objective’s text and actions, evaluating its potential to provide clarity on states’ duties and to address practical barriers to access. The lack of definition for the term ‘basic services’ is a regrettable shortcoming that creates potential for restrictive interpretation by states. Nevertheless, Objective 15 contributes operationalizing and contextualizing human rights norms within migration governance, particularly by emphasizing non-discriminatory service delivery. Whereas Objective 15 may serve as a crucial tool for advocacy and accountability of states, its effectiveness hinges on robust implementation that genuinely prioritizes human rights of migrants over exclusionary policies.
