Abstract
Abstract This chapter describes the difficulties of implementing in practice the cooperation between home and host supervisors in the case of cross-border insurance business. It starts with underlining the important growth of cross-border insurance services in the EU. It then recalls the present regulatory regime for cross-border supervision under Solvency II, both in the case of freedom of services and freedom of establishment. It then looks at the 2019 review of the European system of financial supervision, which led to the introduction of collaboration platforms to be set up or to be coordinated by EIOPA. The chapter continues with a description of the changes introduced by the Solvency II 2020 Review, for which the further integration of the EU Single Market and the enhancement of competition across the Single Market were important goals. The chapter describes the discussions surrounding the introduction of a definition of significant cross-border activities and the new measures applicable to insurers carrying out such activities. After summarising the new provisions relating to collaboration platforms, the chapter concludes with some critical comments about the new regulatory regime.
