Abstract
Abstract In 2011, the Financial Stability Board (FSB) adopted the first version of the Key Attributes of Effective Resolution Regimes for Financial Institutions (Key Attributes), including insurance institutions, with a view to ensuring the recovery and resolution of financial firms in the event of distress. The objective is to enable financial institutions that are failing or are likely to fail to exit the market without recourse to public funds, while ensuring the continuity of critical functions and avoiding potentially value-destroying bankruptcy proceedings. Several jurisdictions have initiated projects with the objective of transposing these standards into a supranational directive or national legislation, respectively. This chapter compares the regimes in the European Union, in the United Kingdom, and in Switzerland. While there are significant commonalities that can be traced to the Key Attributes, the degree of differences is nonetheless notable. These differences are of varying importance from an international perspective but require continued attention and facilitation of implementation across borders.
