Abstract
Abstract This chapter outlines the historical foundations and general legal framework of EU gender equality law. It shows that EU gender equality law has expanded significantly since its origins in Article 119 EEC Treaty and is now constitutionally deeply embedded. The chapter provides the broader EU law context which is necessary to understand the substance and the development of EU gender equality law, covering topics such as the EU legal bases of gender equality law, sources of the law, and institutional dynamics. Particular attention is paid to the constitutional duty of gender mainstreaming, as well as the relationship between EU gender equality law and non-discrimination law on the other grounds covered by Article 19 TFEU (race and ethnicity, age, disability, religion and belief, and sexual orientation). Furthermore, in line with the broad approach of the book, this chapter places EU gender equality law in the broader context of both Council of Europe and international human rights law and international labour law. The chapter concludes by examining gender-based violence as an emerging field of EU law, underscoring the dynamic nature of the EU gender equality legal framework.
