Abstract
Abstract This chapter aims to provide foundational analyses of the law protecting submarine cables and pipelines, as “critical undersea infrastructure,” in the context of a potential armed conflict in the Indo-Pacific region. Thanks to the development of technology, the functions and networks of undersea infrastructure have become highly varied and greatly expanded. In recent years, serious sabotage against them has frequently taken place in a short time sequence. The law of the sea and the law of armed conflict do not effectively and completely respond to and regulate these rapid developments regarding undersea infrastructure. To move forward, the chapter examines the “criticality” of undersea infrastructure, entities that might be injured by harmful acts; the entities responsible for such harmful acts; the possibility that sabotage might amount to an “armed attack”; and whether undersea infrastructure could be a military objective under the law of armed conflict. The chapter concludes by suggesting an urgent need for new rules of international law specifically designed to address the protection of undersea infrastructure.
