Abstract
Abstract This chapter discusses the new provision of Article 17 of the ICDR Rules that expressly authorizes the tribunal to appoint a tribunal secretary subject to the consent of the parties and the requirement that any such secretary will comply with guidelines established by the ICDR. The ICDR issued such guidelines in 2022 in the ICDR Guidelines on the Use of Arbitral Tribunal Secretaries, which set out appointment mechanics, required disclosures, scope of permissible tasks, supervision, and the non-delegable nature of decision-making. The new Article 17 largely formalizes the authority that a tribunal already had to appoint a tribunal secretary, but it also reflects a broader trend across leading arbitral institutions towards rule-based regulation of tribunal secretaries that includes clear non-delegation safeguards with a supervised scope of permissible tasks.
