Abstract
Abstract A key component of the trilateral AUKUS partnership is the provision of nuclear-powered submarines to Australia, a non-nuclear-weapon state, which has raised some important political and legal questions. This chapter acknowledges the dual narratives surrounding AUKUS submarines: One advocating for their strategic necessity against rising geopolitical threats, and the other highlighting potential risks to the nuclear non-proliferation regime. The chapter delves into the legal complexities of the second narrative by exploring the implications of AUKUS for the Nuclear Non-Proliferation Treaty and International Atomic Energy Agency verification framework. It also addresses concerns in the Indo-Pacific region, including the impact on nuclear-free zones, navigation rights under the law of the sea, and environmental risks. By analyzing these issues, the chapter contributes to the ongoing discourse on the future of non-proliferation and the need for a robust international legal framework to govern military uses of nuclear technology.
