Abstract
Abstract At the outbreak of any armed conflict, a critical step for those who must apply the law of armed conflict is conflict classification—is the armed conflict taking place an international armed conflict (IAC) or a non-international armed conflict (NIAC)? Depending on the outcome of such an assessment, persons who participate in the armed conflict may be designated as combatants and entitled to prisoner-of-war (POW) rights. This chapter examines whether POW status would apply to persons participating in a possible conflict in Taiwan. The chapter notes the criteria in the law of armed conflict for designation as a POW, and the rights to which POWs are entitled. The chapter then examines how any conflict in Taiwan could be categorized and what that characterization would mean for persons participating in such a conflict. Finally, the chapter considers whether the standard criteria for POW determination contain any implied requirements or limitations, such as whether nationality or allegiance impacts designation as a POW.
