Abstract
Abstract International law plays a rich and varied role in the U.S. legal system. Sometimes this role involves the direct application of international law, but often it involves more complicated interactions. Domestic law and institutions typically mediate the application of international law in the United States and, in doing so, international law is inevitably altered. To understand how international law operates in the United States, it is necessary to understand the basic structural features of the U.S. constitutional system, particularly the separation of powers among the three branches of the federal government and the federalism relationship between the national government and the states. It is also important to be attentive to history. The approach of the U.S. legal system to international law has changed over time, as both international law and the place of the United States in the world have evolved. In part because of historical contingency, many issues surrounding the status of international law in the U.S. legal system are never entirely settled.
