Abstract
Alter thirty years of being passed the spanish Constitution in 1978, the aim of this paper try to remind the on-going debates celebrated at the House of Representatives about one of the most controversy issues: the education.
Through the parliamentary debates we can take into account the political figh- ting between the differents parties on how education should be set up in Spanish democracy. Finally, the Constitution shows a balance between the recognition of right of education and the freedom of education as well.
