Abstract
A noção de contrato, assim como outros institutos jurídicos, sofreu transformações de acordo com o momento histórico da sociedade em que se insere. Com a evolução da teoria contratual, especialmente o advento do Código Civil de 2002, percebe-se uma evolução na teoria dos contratos com a inserção de novos princípios contratuais, tais como a boa-fé objetiva, a função social do contrato e o princípio da equivalência material, além dos já consagrados princípios fundamentais da autonomia da vontade, do pacta sunt servanda e da relatividade dos efeitos. Isso evidencia uma maior preocupação com os interesses sociais envolvidos, e a tentativa de realização de contratações mais justas e equitativas.
