Abstract
Este texto visa contextualizar dois momentos em torno da construção jurídica da violência sexual contra mulheres: 1) nos casos de crimes sexuais que chegavam no judiciário em inícios do século XX  --  os crimes contra a “honra das famílias”, e 2) no contexto do desenvolvimento do feminismo, a partir dos anos 1970. Estes dois momentos marcam a construção jurídica da violência sexual, ora pautada pelo predomínio do valor família, ora pelo reconhecimento dos direitos individuais das mulheres. Proponho a noção de “feminismo de direitos” como um conceito analítico quanto à interlocução entre movimento feminista e Direito, a partir da agenda política violência contra as mulheres, no contexto brasileiro.Palavras-chave:  Violência Sexual  –  Feminismo  –  Direitos  Humanos das MulheresABSTRACT:  This text aims to contextualize two moments around the legal construction of sexual violence against women: 1) in the cases of sexual crimes which arrived in court early in the twentieth century  -  crimes against "family  honor", and 2) in the context of the development of feminism starting in the 1970s. These two points mark the legal construction of sexual violence, at times guided by the predominance of family values, at others by the recognition of individual rights of  women. Finally, I propose the concept of "feminism of rights" for an analysis of interactions between the feminist movement and Law, from the political agenda of violence against women in the Brazilian context.Key-words: Sexual Violence - Feminism - Women's Rights
