Abstract

The idea of right to body autonomy grows more important as people are able to donate their organs. However, the two conceptions of rights currently applicable, i.e. ‘ownership’ and ‘possession’, are highly inappropriate to be applied to this case because human body is not a property. In this light, humanity purposes constitute stronger concept of body
autonomy.


Pemahaman akan hak atas tubuh menjadi semakin penting ketika seseorang dapat mendonorkan organ tubuhnya. Kedua konsep hak yang selama ini berlaku, yaitu konsep “ownership” dan “possession” ternyata jika diterapkan ke hak atas tubuh sangat tidak sesuai karena tubuh manusia bukanlah barang. Dalam kondisi inilah konsep hak dengan tujuan kemanusiaan memberikan dasar yang kuat tentang hak atas tubuh.
