Abstract
Hak untuk melakukan perkawinan menjadi unsur yang penting dalam masyarakat, karena perkawinan menyangkut hak individu yang berhubungan dengan masyarakat. Masyarakat memandang bahwa perempuan tidak mempunyai hak mandiri dalam masalah perkawinan sehingga apabila memilih jodoh maka harus dipilihkan orang tua. Hal ini berbeda dengan pandangan masyarakat Islam tentang anak laki-laki bahwa bagi mereka jodoh adalah urusan Tuhan, bukan orang tua. Tulisan ini membedah secara tuntas pemikiran KH. MA. Sahal Mahfudh tentang hak Ijbar. Pemikiran KH. MA. Sahal Mahfudh tentang hak Ijbar berusaha mengambil jalan tengah di antara perbedaan pandangan antar madzab dengan tetap menjadikan pertimbangan kemaslahatan sebagai acuan utama.
