Abstract
Este trabalho pretende retomar o capítulo de educação na Constituição de 1919 da República Federativa Alemã, conhecida como Constituição de Weimar. Essa assinala um momento importante da presença do Estado na afirmação e garantia de "novos direitos": os direitos sociais. Aí incluída, a educação ganhou um capítulo próprio onde se destacam - além da constitucionalização do direito - a gratuidade, a obrigatoriedade, a presença do Estado nos seus diferentes níveis, o público/privado e o ensino religioso. A importância deste texto constitucional, contexto geral de sua produção e a inexistência de tradução em português foram os móveis da produção deste trabalho.
