Abstract
O texto tem como objetivo investigar qual seja o papel da argumentação no direito no que se refere ao seu real alcance gnosiológico e à sua efetividade enquanto estabelecimento de consensos. O debate funda-se na contraposição entre a filosofia cética do pirronismo e as recentes teorias da argumentação jurídica. A principal tese é que a argumentação não pode ser considerada mais um instrumento a serviço dos filósofos dogmáticos com objetivos sistematizadores e racionalizantes de seus discursos epistêmicos. Pelo contrário, seu lugar de origem seria entre os céticos, restringindo-se, portanto, exclusivamente a seu caráter retórico e fenomênico.
