Abstract
Članak analizira značenje višestupanjske zaštite ljudskih prava koju omogućuju ustavni sudovi u Njemačkoj, Hrvatskoj, ECJ I EctRH. Iako svoj rad temelje na različitim funkcijama i vlastitim koncepcijama prava članak ukazuje da je blagodat simultane zaštite ljudskih prava uzajamna supstitucija, nadopunjavanje I neformalne korekcije sudova. Dok Europski sud za ljudska prava (ECtRH) ima vodeću funkciju u zaštiti klaičnih ljudskih prava središnju točku ECJ predstavljaju temeljn a ekonomska prava. Nacionalni ustavni sudovi kompletiraju zaštitu ljudskih prava te prednjače u otvaranju socijalnih I kulturnih aspekata. U tom smislu pluralizam sudova koji štite ljudska prava omogućuju šire prihvaćanje, učinkovitost I unifiormnost zaštite ljudskih prava u Europi. Više je argumenata ovog članka potvrdila i Odluka njemačkog Ustavnog suda o Lisabonskom ugovoru od 30, VI. 2009 (2 BvE 2/06).
