Abstract
A partir des instruments juridiques universels, un nombre important de documents a été conçu, négociéet adopté à niveau européen, documents qui consacrent les moyens de garantie et de protection des droits del’homme et des libertés fondamentales.La Convention européenne est le premier instrument international qui fait référence aux droits del’homme, ayant pour but la protection d’un large éventail de droits et de libertés civils et politiques et quiinstaure un système de contrôle sur l’application des droits de niveau interne si la procédure est initiée par unindividu et non pas par l’Etat.Dans cet exposé, on a essayé d’analyser les principaux droits civils et politiques réglementés par CEDH(La Cour européenne des droits de l’homme) et les débats qui existent dans la jurisprudence à ce sujet.
