Abstract
يهدف هذا البحث إلى تطبيق علم المقاصد الشرعية على فقه المعاملات المالية وما استجد منها وما طرأ من مسائلها التي تزداد وتستجد في كل زمان وكل مكان، وإلى تبيين تلك العلاقة بين المقاصد الشرعية وفقه المعاملات المالية الإسلامية. وقد اتبع الباحث في بحثه المنهج الاستقرائي، وذلك من خلال تتبع ما كُتب من جزئيات في المقاصد الشرعية عموما محاولا التركيز على فقه المعاملات المالية خصوصا، وتبيين أثر المقاصد الشرعية في مسائل فقه المعاملات المالية التي تناولها الفقهاء في مؤلفاتهم. ومن أهم النتائج التي توصل إليها البحث: أن الشريعة الإسلامية قد اعتبرت عددا من المقاصد العامة في تشريع المعاملات المالية خاصة، والنظام الاقتصادي عامة. وأن لمقاصد الشرعية أثرا بالغا في ترشيد وتوجيه الفتوى الشرعية، لاسيما في الحكم على مستجدات المعاملات المالية. وأيضا حث العلماء والبحاث إلى تطبيق علم المقاصد على المعاملات المالية الإسلامية ومستجداتها.
