Abstract
Resumen:
El ejercicio de la jurisdicción universal no está regulado por el Derecho internacional sino que son los propios Estados los que establecen las disposiciones que entienden más adecuadas para su ejercicio frente a los crímenes internacionales. Entre las diversas condiciones establecidas por el poder legislativo estatal se encuentran las amnistías, que si bien están prohibidas en el Derecho internacional, en el ámbito estatal se convierten en auténticos obstáculos al ejercicio del principio universal que nada tienen que ver con su finalidad última.
Abstract:
The exercise of universal jurisdiction is not regulated by international law, but rather it is the States themselves that establish the provisions they deem most appropriate for their exercise in the face of international crimes. Among the various conditions established by the state legislative branch are the amnesties, which are prohibited in international law, but at the state level they become real obstacles to the exercise of the universal principle that have nothing to do with the ultimate purpose of the universal jurisdiction.
