Abstract
Kur'an, insanın medeni yapısını ve onun sosyal bir varlık olduğunu açıklar.1 Bu nedenledir ki, İslam, insanı, bütün samimiyeti ile bu fıtri yapısını sürdürmeye çağırır.2 Çünkü hukuk sistemleri insanın bu yapısı üzerine düzenlenir. Hukuk, sosyal hayatı düzenleyen normatif kurallar bütünü olarak ifade edilmektedir. Çünkü insan hayatı sosyal özellik arzeder. Sosyal hayat şartlarını düzenleyen kurallara duyulan ihtiyaç kaçınılmaz bir gerçektir. Nitekim, büyük sosyolog İbn Haldun (808/1406), sosyal hayatın insan için bir zorunluluk olduğunu belirtir, filozofların insanın yapısında "medeni " bir özelliğin bulunduğuna ilişkin ortaya koydukları değerlendirmelerine yer verir
