Abstract
The role of the judiciary in the implementation of Hudood and Tazirat in Pakistan is a critical area of legal discourse. Since the enforcement of the Hudood Ordinance of 1979, the judiciary has played a pivotal role in interpreting and enforcing Islamic punishments. This study aims to critically examine the judiciary's involvement in the enforcement of Hudood laws, focusing on the challenges, contradictions, and reforms needed in the judicial interpretation and application of these laws. Through a comparative analysis, the paper evaluates how the judiciary has shaped the implementation of Hudood and Tazirat, discusses the impact of judicial decisions on society, and explores the need for judicial reforms to ensure the effective and equitable implementation of Islamic law. The findings suggest that while the judiciary's role is essential, there is a pressing need for reforms to ensure consistency, fairness, and justice in the enforcement of these laws.
