Abstract
The research focused on methodology of Imam Abd al-Wahab al-Sh’rani in “al-Mizan al-Kubra” and the creation of “al-Mizan” (The Scale) for the division of juristic opinions among two categories, namely Rigid and Concession. According to Imam al-Sh’rani, although most of the Islāmic injunctions fall under these two categories, however, there are some cases which negate this principle due to unified Jurisitic opinion. Similarly, there are problems which contain more than two views, resulting in inclusion of one in Rigidity and other in Concession. An important fact here is that these cases are related to analogical problems, rather than principles of Islāmic Sharīʿah. The scale (Mizan) highlights the fact that the views of all Muslim Jurists in a particular problem are correct and the public has the right to opt any of them. The reason for the validity of all Juristic views is due the fact that these are connected to the core of Sharīʿah, just like a branch of a tree is connected to its roots. Similarly, the disagreement among some scholars is due to infamilirity with the source of opinion of these Jurists. According to al-Sh’rani, like legal injunctions, general public is also divided among these two categories – of Rigidity and Concession – on the basis of their physical and religious conditions. A person who is liable for Rigidity cannot opt for Concession by his own will, however, the reverse is allowed. Finally, according to al-Sh’rani, the benefit this scale (Mizan) is that it prevents a person from negating Jurists who are related to different school of law (Fiqh), thus making him a candidate for intercession on the day of Judgment.
