Abstract
Communicable and airborne disease are those that are transmitted from one person to another by mere interaction. Taking this into consideration, they pose a threat to life and health of all other persons surrounding them. Should these patients be forcefully admitted in a medical facility however would violate their constitutionally guaranteed rights. On the other hand, there is already the Rule in Hospitalization under Rule 101 of the Rules of Court. Should the Court include this disease however, a case would be hard to prove without a physician who can give a positive finding in the patient. With these conflicts will this research delve into. Justifying the inclusion of communicable and airborne disease in the rule in Hospitalization.
