Abstract
The emergence of the Transport Network Companies and Transport Network Vehicle Services created a legal grey area. The questions as to whether or not these entities are common carriers and whether they should be regulated by the Land Transportation Franchising and Regulatory Board arose. The study discusses why TNCs and TNVS are considered common carriers. It also discussed why these entities are subject to regulation, characterizing their services as public utility services. It also discussed why the Department of Transportation and the LTFRB are the proper authorities to regulate the TNCs and TNVS. The proponents concluded that clear guidelines for the regulation and operation of the TNCs and TNVS must be issued by these government agencies.
