Abstract
It should be remembered that our 1987 Constitution has been drafted particularly against a dictator president. However, in this present administration it is alarming and unfortunate to know that the presidential power to pardon is intended to be subject to abuse to further a president’s mandate. While under the constitution, the pardoning power is absolute and discretionary on the part of the president, this does not mean that the president has can use the same to defeat the end of justice or strip family of the victims of extra judicial killing (EJK) of remedy granted to them by the Constitution and other laws. The proponents intended to answer the following questions with regard to the exercise of pardoning power of the president: (a) Why there is a need to abolish the pardoning power of the President over public executive officers of the government; (b) What are the possible consequences of pardoning public officers in the executive department and law enforcement agencies who committed felonies?; and (c) Does the exercise of pardoning power of the President in favor of public officials in the executive department makes the public officer immune from punishment or penalty of the law?
