Abstract
Corollary to our constitutionally recognized right to property29 is our right to defend such property. It is empirical that such limitation is defined in detail to prevent further curtailment of one’s right to defend his property. This legal research advocates the usage of legal firearms to repel crimes and felonies against property after sufficient notice and warning. A privilege to restrict the use of legal firearms as a defense against unlawful aggression to one’s property renders the purpose nugatory by which it is granted. The essence of the privilege of granting the use of the legal firearm is not fully satisfied if there is a legal hindrance in using the legal firearms as a reasonable means to repel unlawful aggression against one’s property. On the other end, a privilege too loose is open to abuse by the holder, more often than not defeats the purpose by which the privilege is granted. It is therefore imperative that legislation, or at the very least, implementing rules and procedures are enacted to delineate the extent of the privilege. The study shall explain the need of legalizing the use of licensed firearm as a rational mode to deter unlawful trespass to dwelling and robbery by describing the current criminal atmosphere in the Philippines. On the other side of the same coin, the objective is to argue that the unjustified usage of a Permitted Firearm will be construed against the armed citizen should he, in a blatant and capricious way, abuse such privilege.
