Abstract
A trade secret is one of the most important assets of countless firms the revelation of which will lead to the make or break point of a company. Although it is evident that trade secrets are valuable, there is no law in the Philippines that directly provides for its preservation.;"It has been subjected to various case applications because there are no concrete and specific grounds that address trade secrets as a particular concept. Even with the adaptation of commonly used definitions of trade secrets, such as Black Laws and the 1929 Restatement of Torts, the Philippine Jurisprudence has not been able to codify its own law or legal definition for this matter.";"With the high rising cases of Intellectual Property, and the Philippines' growing economy in terms of products and technology development, it is a must that the state ensures collective protection on trade secrets to alongside protect its people.This thesis aims to propose a law for the protection of trade secrets in the Philippine setting by Philippine and American jurisprudence for the Intellectual Property Code is silent about the protection of undisclosed information, clashing with trade secrets.
