Abstract
The Philippines despite being famous for its people, and other works, is also notorious for having a corrupt and almost untrustworthy government. Its mode of maintaining public accountability has always been questioned, and is considered relatively ineffective. Recently, a case has been raised against Jejomar Binay, then Vice President of the Republic. The offenses committed were done at the time when he was not yet an impeachable official, and now, he is running for the highest executive position, which is the Philippine presidency. The researchers therefore looked for an answer to the question can and should his past offenses be used as ground for impeachment?The lack of jurisprudence made it difficult to find an answer, but through review by statutory construction, and the review of previous impeachment cases, both local, and in the United States, allowed the researchers to provide a conclusion regarding this problem."
