Abstract
De la observación de un caso judicial, el artículo tiene como objetivo analizar la problemática de los temas relacionados con la efetividad del patrimonio cultural de las comunidades quilombolas, prevista normativamente en la Constitución Federal brasileña, pero cuya facticidad se difiere del texto constitucional. Para una mayor discusión, el trabajo se estructura de la siguiente manera: a) la complejidad polifónica del patrimonio cultural; b) la necesidad de participación de las comunidades en el proceso de adopción de decisiones que definirán la política de protección; c) el discurso técnico frente la realidad de la práctica: para una democracia sin malentendidos.
