Abstract
O objetivo geral deste artigo é investigar a construção teórica do Estado de Direito Ambiental e a particularidade de uma hermenêutica jurídica ambiental com vistas a minimizar os efeitos da crise ambiental. Os princípios interpretativos utilizados na hermenêutica ambiental não têm como oferecer respostas únicas e exclusivas, haja vista que, como consta na hermenêutica filosófica, o sentido a ser captado da norma é inesgotável. Mesmo que o jurista utilize todos os princípios indicados, ainda assim haverá margem para subjetividade e arbitrariedade.Abstract: The general purpose of this paper is to examine the theoretical structure of the Environmental State of Law and the particular character of an environmental juridical hermeneutics, both aiming at minimizing the effects of the environmental crisis. Theconclusion is that interpretation principles used at environmental hermeneutics are not able to offer singular and ultimate answers, because meaning is inexhaustible, as philosophical hermeneuticsdemonstrates. Even if legal professionals use all the relevant principles indicated, there will always be room for subjectivity and discretion.
