Abstract
O estudo objetiva compreender anoção de espaço público, utilizando-se paratal da obra de Hannah Arendt, e o declíniodessa esfera na Modernidade, com a concomitanteemergência do social. Enfatiza opapel do Direito, como ele foi e tem sidoentendido por autores clássicos e contemporâneosem relação à sua interpretação e aplicação,bem como procura analisar quais asconseqüências das decisões judiciais para aconstrução, ampliação ou limitação do espaçopúblico. Destaca-se a importância doDireito, seu compromisso com a busca da justiçae com a consolidação da democracia, umavez que este tem sido cada vez mais chamadoa dar soluções para os conflitos oriundosdas desigualdades econômicas e sociaisvivenciadas no Brasil.The present study intends tounderstand the concept of public place, usingfor this purpose Hannah Arendt’s work, andthe deterioration of the public place inmodern era, with the concurrent growing ofsocial place. It gives special emphasis to Law’srole, how it had been and has been understoodfor classic and contemporary authorsin relation to its interpretation and application,as well as the study tries to analyzewhat are the consequences of the judicialdecisions for the construction, extension orlimitation of the public place. Finally, itaccentuates the importance of the Law andits compromise with justice and democracy,therefore the Law has been called everydaymore to give solutions for the conflictscoming from the social and economicinequalities of Brazil.
