Abstract

En un notable estudio publicado en el año 1978 Natalino Irti1 lanzó en Italia una contundente señal de alarma sobre la descodificación del Derecho Privado, producto de la creciente proliferación de leyes especiales y microsistemas, que día a día expropian al Código Civil materias enteras, leyes dotadas de principios y de una lógica orgánica propia, que conducen en definitiva a una verdadera fuga de su contenido.
