Abstract
O presente trabalho tem por objetivo gerar uma reflexão sobre o alcance do principio democrático para a pessoa com deficiência, principalmente as internadas em unidades hospitalocentricas e/ou casas abrigo. Mostra-se também a necessidade de se erigir do texto constitucional uma ética social, que permeia as relações entre cidadãos e as relações entre órgãos públicos e cidadãos, tendo por objetivo o respeito pela deficiência entre os cidadãos e pelo gestor da politica publica respectivamente, visando a garantia dos direitos fundamentais. Utilizou-se para este trabalho uma metodologia indutiva – bibliográfica, com base na teoria John Rawls e Kant.
