În prezentul demers ştiinţific se pune în discuţie obiectul juridic al infracţiunilor prevăzute la art.290 şi 291 CP RM. Astfel, este identificat obiectul juridic general, obiectul juridic generic şi obiectul juridic special al acestor infracţiuni. Analizei este supus conţinutul noţiunii „securitate publică” în calitate de valoare socială fundamentală lezată prin comi­terea infrac­ţiu­nilor prevăzute la art.290 şi 291 CP RM, aflându-se în derivaţie organică cu obiectul juridic special al respectivelor infracţiuni. S-a arătat că securitatea publică este o stare de fapt inerentă unei colectivităţi umane prin care se asigură liniştea în sânul societăţii. S-a demonstrat că prin comiterea infracţiunilor analizate se atentează asupra drep­turilor şi intereselor unui grup de persoane, dar nu asupra drepturilor şi intereselor unei singure persoane.

LEGAL OBJECT OF OFFENCES PROVIDED BY ARTICLES 290 AND 291 PC RM

In the carried out study is put in question legal object of offences provided by articles 290 and 291 PC RM. Thus, general legal object, generic legal object and specific legal object is identified. An important aspect analyzed is formed determination of “public security” as the fundamental social value injured by the offences provided to in articles 290 and 291 PC RM, being in the organic branch with special legal object of these crimes. It has been demonstrated that public security is a fact inherent in a human collectivity that ensures peace in the bosom of society. It has been demonstrated that the analyzed crimes encroaching on the rights and interests of a group of people, but not on one person.
