Abstract

Este artigo discute a mediação extrajudicial como um campo de práticas e saberes em desenvolvimento no Brasil, analisando sua dinâmica de atendimento e o que ela produz como justiça, tendo como foco um Balcão de Direitos − programa da Secretaria Especial de Direitos Humanos da Presidência da República − em Olinda e outro no Rio de Janeiro. Os diferentes ideais que operam a mediação aparecem mesclados nos atendimentos, refletindo-se na multiplicidade de práticas levadas a cabo pelos mediadores e orientando a produção de diferenciações e hierarquias entre os sujeitos envolvidos e na relação entre a própria justiça do diálogo e a Justiça comum.

 

Justice through Dialogue: A Review of Out-of- Court Mediation and the ‘Production of Justice’ discusses out-of-court mediation as a developing field of practice and expertise in Brazil, analysing how it works and what it produces as justice, focusing on the Balcão de Direitos in Olinda and another in Rio de Janeiro. We observed that the different ideals that operate the mediations seem mixed in the services, reflecting a variety of practices carried out by the mediators and leading to the production of differentiations and hierarchies between the parties involved and in the relationship between the actual justice through dialogue and regular courtroom justice.
