Abstract
Para as filosofias ontológicas,essencialistas, claramente dominantes na tradiçãoocidental e na filosofia do direito atual, a linguagemé mero instrumento, um meio para a descobertada verdade, que pode ser aparente, para umas,ou se esconder por trás das aparências, para outras,com todas as combinações e ecletismos. Ocomum é a idéia de que, com método, lógica, intuição,emoção e todo seu aparato cognoscitivo competentementeaplicado, é possível aos seres humanoschegar à verdade, assertiva que coagiriatodos a aceitá-la (“racionalidade”). No campo ético,a verdade equivale a correto, justo e outrosadjetivos laudat��rios. Este artigo defende a tesede que isso é uma ilusão altamente funcional e queos precários acordos da linguagem não são apenaso máximo de garantia possível, são a única. E aindaque seja temporária, autopoiética, circunstanciale freqüentemente rompida em suas promessas,é só o que se pode chamar de “racionalidade”.According to ontological, essentialistphilosophies, clearly prevailing in Westerntradition and in contemporary philosophy oflaw, language is a mere instrument to the discoveryof truth, which can be apparent to some, or tohide behind appearances, to others, with allcombinations and eclecticisms. The common ideais that with method, logic, intuition, emotion andall their knowledge apparatus, it is possible forhuman beings to find truth, statements whichwould compel everyone to acceptance(“rationality”). In what ethics is concerned, truthequals correctness, justice and other laudatoryadjectives. This paper defends the thesis thatthis is a highly functional illusion and that theprecarious agreements of language not onlyconstitute the maximum possible guarantees, theyare the only ones. Moreover, despite beingtemporary, autopoietic, circumstantial andfrequently disrespected, this is all that can becalled rationality.
