Abstract
O artigo se propõe a refletir sobre o “perdão” como valor que organiza as relações desdobradas em torno do tratamento penal da figura de inimputabilidade. Essa opinião é corroborada pela análise de uma intervenção específica: o caso de Luis, processado por vários homicídios na década de 1980 na Argentina. Esse percurso é oferecido como uma possível explicação de como, no funcionamento do Sistema de Justiça Penal, a mediação moral distingue emoções como forma de apoiar certas decisões e práticas. Ao mesmo tempo, são descritas as transformações históricas em uma série de instituições para seu tratamento ao longo de 28 anos de confinamento.
The article The case of Luis: Moralities, Emotions and the Penal Device of ‘Forgiveness’ proposes to reflect on “forgiveness” as a value that organizes the relations that develop around the penal treatment of the figure of unaccountability. This opinion is supported by the analysis of a specific intervention: the case of Luis, charged with several murders in the 1980s in Argentina. This case is offered as a possible explanation of how, in the workings of the Criminal Justice System, moral mediation distinguishes emotions as a way of supporting certain decisions and actions. At the same time, a description is presented of the historical transformations that have occurred at institutions where he has been treated over the course of 28 years of confinement.
