Abstract
Este estudio interpreta el ambiguo artículo 4.1 de la Convención Americana sobre Derechos Humanos, que dispone que el derecho a la vida deberá protegerse, "en general, a partir del momento de la concepción". Al hacerlo, toma en cuenta diversos sistemas de interpretación, y tiene presente lo registrado en los trabajos preparatorios de la Convención. Asimismo, este estudio analiza lo que la Comisión Interamericana ha resuelto en esta materia, evaluando el valor de tales decisiones. Este artículo concluye que, si bien una de las posibles interpretaciones de la Convención Americana sostiene que ella toleraría ciertas legislaciones nacionales que permitan el aborto en circunstancias excepcionales, ella declara la personalidad del nasciturus.
This study interprets the ambiguous Article 4(1) of the American Convention on Human Rights, which establishes that life shall be protected "in general, from the moment of conception". When doing so, it pays attention to different interpretive systems, and takes into account what is recorded in the travaux préparatoires of the Convention. Likewise, this study analyzes what the Inter-American Commission has determined on this issue, and assesses the value of those decisions. This article concludes that, even though one of the possible interpretations of the American Convention affirms that it would tolerate domestic legislations providing for abortion in exceptional circumstances, it declares the unborn's personhood.
