Abstract
O presente artigo tem por objetivo questionar os termos e a existência do debate contemporâneo sobre Justiça na Filosofia do Direito. Para tanto, foram apresentadas duas diferentes interpretações atuais sobre o conceito de Justiça – justiça equitativa ou substantiva e justiça procedimental. Cada qual dessas vertentes tem seus próprios pressupostos teóricos e se pretendem divergentes. A questão é verificar se de fato há alguma oposição entre essas vertentes teóricas. Cabe discutir se a presença de elementos metafísicos na fundamentação dessas teorias autoriza deduzir um esvaziamento político do conceito de justiça. Nesse caso, o debate sobre Justiça na Filosofia do Direito sucumbiu à harmonização das soluções aceitas, sendo somente viável a discussão dos pressupostos considerados e avaliados por cada teoria.
