Abstract
Este artigo analisa as teorias do mínimo existencial e da reserva do possível como retrocessos à efetivação do direito à saúde no Brasil. Utiliza-se a metodologia histórico-dialética para demonstrar o caminho da construção intelectual de ambas as teorias, desde o surgimento no direito constitucional alemão até sua aplicação no constitucionalismo brasileiro com os específicos impactos no Direito Sanitário em nossa realidade.
