Abstract
This article reports analyses and conclusions formulated from comments about Brazilian Justice and that they had given to origin the thesis Criminal Justice in Current Brazil: Democratic speech - practical authoritarian. This article aims to reflect on contemporary democracy and its paradoxical coexistence with excessof order. More than mere coexistence, there is the need to subdue thedemocratic ideal to authoritarianism. This democracy, evidenced in Brazil after the political opening that occurred in 1985, he fits the liberal project also underway in the country and in virtually all the capitalist West.
