Abstract
O presente trabalho apresenta umadescrição acerca das interfaces e acoplamentoshavidos entre o Direito e a Política na SociedadeContemporânea. Diante da noção de“Policontexturalidade”, como critério deinvestigação da fragmentação do sentido na pósmodernidade,tem-se a possibilidade de confecçãode uma interessante análise do Pluralismo JurídicoTransnacional. Acompanhando as “irritações”emanadas dos riscos ambientais produzidos pelaSociedade atual, está o “Estado Ambiental” que éum re-direcionamento da função do Estado comoorganização política visando a abordagem de seuslimites e invenções para a sua manutenção comoAtor Social privilegiado. Nesta dinâmica, os novosDireitos são o campo temático onde a observaçãoPolicontextural e a operacionalidade organizacionaldo Estado estão redefinindo a complexidade doacoplamento entre o Direito e a Política do pontode vista de um Direito Reflexivo.This work presents a description ofthe coupling between Law and Politics inContemporary Society. Under the expression“Polycontexturality”, as a criterium to investigatethe sense fragmentarion in post modernity, thereis a possible and interesting analysis of theTransnational Legal Pluralism. Following the“irritations” caused by ecological risks in ourSociety is the “Environmental State” which meansa new function to the State, as a politicalorganization with the scope to maintain itself as aprivileged social actor. Thus, the new rights arethe place where the Polycontextural Observationand the State organizational operation areredefining the complexity over the relationsbetween Rigth and Politics, under the sight ofReflexive Rigth.
