Abstract
<span style="font-size: 12pt; font-family: "Times New Roman";">O presente artigo visa analisar a Diretiva de Retorno da União Européia. Esta normativa comunitária, que entrará em vigor no presente ano, causou polêmica em seus debates prévios não apenas na Europa, mas em todo o mundo, por permitir, por exemplo, a detenção de imigrantes ilegais na União Européia (UE) por até 18 meses. Pretende-se com este trabalho chamar a atenção para o fato de que a União Européia parece querer “criminalizar” o imigrante ilegal pelo simples fato de encontrar-se nesta situação, indo de encontro a um dos efeitos sadios da globalização, no caso, a possibilidade de integração e solidariedade de povos e culturas distintas.</span>
