Abstract

Es sabido que las corrientes doctrinarias son filtradas por la jurisprudencia recogiéndolas o rechazándolas, a través de un proceso que puede durar varios años, por lo cual, es dificil determinar cuando se consolidan efectivamente, se alteran, adaptan o se desconocen.
Las posturas flexibilizadoras en el derecho del trabajo, en sus diferentes versiones,
aparecen en la década de los 80, por lo que se consideró oportuno examinar la jurisprudencia de mediados de la década siguiente, a efectos de dbservar si los criterios flexibilizadores eran receptados, en qué medida y en cuáles aspectos.
