Abstract
Este artigo analisa um tema central da teoria do Direito, o ordenamento jurídico, da perspectiva principal de dois grandes pensadores, Hans Kelsen e Santi Romano. A partir da análise dialética de suas teorias e das contribuições de outros comentadores de suas obras, o estudo se direciona para tentar compreender as similitudes e as diferenças centrais na obra desses dois teóricos, como suas linhas epistemológicas principais e filiações filosóficas. A partir destas comparações, o estudo pretende apontar para as possíveis contribuições que um resgate dos trabalhos de Kelsen e de Romano pode ofertar à filosofia jurídica contemporânea.
