Este artigo analisa a moralidade do abuso sexual em menores, tendo em conta as características da vítima e seu meio familiar e do processo, desde a ocorrência do fato até a denúncia por parte dos familiares e conhecidos, a atenção prestada pelas instituições estatais à vitima e à família, bem como os meios probatórios usados pelos órgãos judiciais no julgamento do provável agressor. Os autores discutem as questões éticas da dinâmica do abuso sexual intrafamiliar, baseados em alguns princípios: autodeterminação, justiça, igualdade, eqüidade, consentimento livre e esclarecido, não maleficência/beneficência, entre outros.
This article analyses the moral character of sexual abuse against minors taking into consideration the characteristics of the victim and its family environment, as well as the process itself, from when the fact occurred until it was reported to the authorities by relatives and acquaintances, the care provided by the State institucional organs to both the victim and its family members. Also, the probatory means used by the judging authorities during the trial of the probable aggressor. The authors discuss the ethical aspects involved in the dynamics of child sexual abuse within the family based on some principles, such as self-determination, justice, equality, equity, free and clear consent, no harmfulness/kindness, among others.
